The Talwar couple on Saturday moved the Supreme Court for a stay in criminal proceedings against them in the twin murder case of their daughter Aarushi and domestic help Hemraj in 2008.
The dentist couple had earlier approached the Allahabad High Court but it refused to stay the proceedings before a special CBI court at Ghaziabad in the case.
The High Court had on Friday rejected the plea of Nupur and Rajesh Talwar for staying the summons by a special CBI court in Ghaziabad in connection with the girl’s murder.
The Allahabad High Court thus paved the way for trial of the parents of the murdered teenager as prime suspects by the CBI in the double murder case.
Aarushi and the Talwar’s help Hemraj were found murdered under mysterious circumstances in May 2008.
The Court asked Nupur Talwar to appear before it in two weeks’ time and apply for bail.
Rajesh Talwar, who had filed a separate petition, was also asked to apply for bail.
The Allahabad High Court had earlier heard of a petition against arrest warrant by Rajesh and Nupur Talwar in the double murder case.
On Feb 9, the special CBI court ordered the trial of doctor couple Rajesh and Nupur Talwar in the murder case of Aarushi and Hemraj.
While the CBI had all along maintained that Rajesh was the only suspect though he could not be implicated due to lack of substantial evidence, Nupur?s name as an accused has emerged for the first time recently.
The dentist couple have been made accused under sections 302 (murder), 201 (destruction of evidence) and section 34 (acts done by several persons in furtherance of common intention) of the IPC.
Fourteen-year-old Aarushi was found murdered, with her throat slit, at the Talwar?s residence in Noida on the morning of May 16, 2008. The body of Hemraj, the Talwars? help, was found on the terrace the next day.
The CBI, in its closure report in the case, had said there were ?gaps in the investigation? and Rajesh Talwar, a dentist, remained the only suspect in the murder case of his daughter and Hemraj.
Rajesh was also arrested by the CBI in the case earlier.
